Terms and Conditions 

 
in addition to the general conditions of the ANVR, the following general conditions: there where these terms and conditions differ from the terms and conditions of the ANVR, these supplementary conditions are valid and pin priority. Please read these terms carefully!
 
 

Acceptance of terms and conditions and disclaimer of liability, claims and damages.

 
By submitting the electronic form or making a booking in any other way or manner, as well as paying the deposit, you agree to be familiar with these Terms and Conditions and to accept it as a binding agreement between you and Crossroads Motortours. You also certify that by submitting the electronic form, there is a binding travel agreement.
 

Crossroads Motortours.

 
All our motorcycle tours are conducted by Crossroads Motortours or by Crossroads Motortours hired third partys.
 

Motorcycle Tours.

 
The term 'motorcycle tours' refers to all activities and services provided, arranged or organized by Crossroads Motortours (located in Venray, registered at the Chamber of Commerce under number 12051080), including, but not limited to: orientation and instruction sessions, transport goods and / or passengers by land, water or air, motor tours and trips in the broadest sense of the word through regular passable and / or remote areas, and all other activities connected with the activities of Crossroads Motortours.
 

Reservation and deposit.

 
Without form or another by Crossroads Motortours accepted agreement, Crossroads Motortours considers the trip as not booked.
When the full amount is not received on time by Crossroads Motortours, it has the right to cancel the reservation and can claim the damage, being at least a minimum as in ANVR terms and conditions, and on top of that up to the entire sum of the reservation, as well as added costs such as the sum of the remaining damage and recovery costs (such as bank and administration), to be payed by the participant.
 

In the price of the tour is included.

 
The description of the tour states exactly what is included in the sum. Normally the reservation includes hotel / overstays in 2-person rooms. Single participants traveling alone will be teamed up to sharing the accommodation. If desired, an optional 1-person room  for single occupancy can be booked additionally.
 

In the price of the tour is NOT included.

 
The description of the tour states exactly what is exclusive in the sum.
 

Luggage.

 
Crossroads Motortours is not liable for loss, theft, damage or delay of baggage of the participants. Even if the luggage is handed over to Crossroads Motortours for transport. We always recommend a good travelinsurance.
 

Change of reservation.

 
Crossroads Motortours can charge costs for changing the reservation, even if this is confirmed and invoiced. The cost increase will only take place with mutual consent and must fit in the program.
In addition, Crossroads Motortours will always be entitled to add any unexpected price increases, such as fuel surcharge, to the price of the tour and make it part of the final total cost that will be invoiced to the customer.
 

Cancellation by Crossroads Motortours.

 
In case of cancellation by Crossroads Motortours, Crossroads Motortours will inform the participants as soon as possible and notify the cancellation. Crossroads Motortours will immediatly return all payments made by the participant to the beneficiary. Crossroads Motortours is not liable for additional self made, in derogation of the standard package. The costs made by the participant, such as airline tickets, hotel reservations and motorcycle / car are at own risk of the participant.
It is possible and allowed that Crossroads Motortours, because of force majeure, has to make the decision to cancel, advance or postpone the tour. Also during the tour excursions, routes, hotels and places can be changed by Crossroads Motortours. In that case Crossroads Motortours is not responsible or liable for any additional costs, losses and inconvenience to the participant as a result of the change(s) in the programm. If the tour is canceled before the departure date, Crossroads Motortours will refund the full amount to the beneficiary.
 

Cancellation by the participant.

 
If a participant prior to, or during the tour, for any reason whatsoever is not (no longer) able to make or finish the tour, there will not be any reimbursement of (part of) the fare . In that case a cancellation insurance can possibly cover the damage (!) .
 

Cancellations and refund of money paid for tours.

 
From the moment Crossroads Motortours has decided that the trip / tour, for which the participant has made reservations, will take place, and crossroads motortours has made for example or the flight reservation, or the reservation of the motorcylce, or hotel reservation, the participant, if canceled by him, on his part, owes the full amount of the complete trip to Crossroads Motortours and has to pay immedeatly. We always recommend a good cancellation-insurance when you make a reservation. The participant has , by acceptance of the terms and conditions, parted from legal rights in this.
 

Minimum number of motorcycle tour participants.

 
Crossroads Motortours can at all times cancel the trip if there are not sufficient participants that have booked and fully paid for that trip. Crossroads Motortours itself determines per tour how many participants are needed to proceed with the tour, or cancel a tour.
 

Deposit and insurance, motorcycle rental.

 
The participants themselves are closing lease with the owner of the motorcycle. Crossroads Motortours is not part of this agreement, even if the rent is payed by Crossroads Motortours.
Before riding the motorcycle, the participant gives the owner of the motorcylce a deposit or credit card pre-authorization to provide for any resulting damage to the motorcycle. This deposit is returned at the end of the tour refunded / (canceled in case of credit card pre-authorization) when the participant returns the motor cycle undamaged. The amount of the deposit varies per tour. Each participant is responsible for having and signing the necessary insurances associated with a motor tour and renting and driving a motorcycle. Consider for example the insurance for the vehicle as well as third party liability insurance at the time of driving a rented vehicle. The participant is responsible for checking and closing this insurance and the amount of the sum insured. If the participant wishes to be insured for a higher amount, he must arrange this himself with the owner of the motorcycle insurer.
Crossroads Motortours advises participants to be well insured for health, accident, motorcyle damage, third party liability (also while driving a rented vehicle), cancellations and other travel-related subjects.
 

No deductible.

 
On some guided tours by Crossroads Motortours in the USA the deductible is zero. However, this is subject to conditions and can be revered / canceled by Crossroads Motortours at any time (also per participant).
The zero deductible is valid on all guided tours that start in the U.S. unless an exception is made. The cancelation of the zero deductible by Crossroads Motortours can be done, prior to the tour but also during the tour and will be indicated by the tourleaders.
The cancelation of the zero deductible will always apply if there is intent, not handling well of the motorcycle, lack of control of the motorcycle, mischief / causes out of the influence of participent or Crossroads motortours such as weather conditions, lack of traffic knowledge and disrespect or breaking the traffic rules or not following instructions given by the tourleaders.
 

Responsibility.

 
Crossroads Motortours can not be held responsible nor liable for collisions or accidents and consequent damage. Also, Crossroads Motortours reserves the right to modify, without prior notice, portions or the entire tour. Also can Crossroads motortours deny a participant riding the motorcycle, if it considers such as necessary, in the context of the observed ridingskills or beheaviours of the participant(s).
The owners and staff of Crossroads Motortours are no guards of the safety of the participants. The participants are, both individually and collectively, responsible for themselves. Therefore Crossroads Motortours can not be held liable or responsible for any incidents during the tour even if leading to injury or death of the participant, damage to his / her property etc..
 

Acceptance of risks.

 
The participant is aware of the fact that motorcycle travel comes with many risks and dangers . These include, but are not limited to: travel over / through extreme hilly or mountainous terrain / area where fallen timber, branches, stones, roots or other obstacles or hazards, steep slopes or unstable ground may cause participent to fall: dangers of travelling on / about / by / through snow, glaciers, canyons, crevasses, streams, rivers and lakes: confrontations with or without wild and / or dangerous animals: various health problems that can be caused by too much sun, insect bites, fatigue, stress, dehydration, overload, altitude and lack of fitness.
The participant is also aware that participants can get lost or the guide or group and can be separated, communication in mountainous and / or remote areas / regions is difficult and in the event of an accident or emergency, it is possible that rescue teams and medical care is not immediatly available, the weather in the mountains or in remote areas may be extreme and can change rapidly and without warning. The participant is also aware that a further risk and danger of motor travel is negligence, carelessness or inexperience of other members of a group.
The participant is aware of the risks and dangers associated with motor travel and accept all risks and hazards and the possibility of injury, death, damage or loss of property as a result. The participant is aware of the fact that he himself has to protect his person and property against the risks and dangers that motorcycle trips entail.
 

Disclaimer of liability, claims and damages.

 
Every participant in a motorcycle tour organized by Crossroads Motortours takes part at their own risk to the tour and he / she indemnifies Crossroads Motortours from all liability.
Each participant states/ declares/garantees:
1. To waive all claims that I have or may in the future have against Crossroads Motortours, their owners, managers and employees and other by Crossroads Motortours engaged persons or companies who in any way contribute to the Crossroads Motortours organized motorcycle tours (hereinafter collectively referred to as "THE RELEASEES") and to release the RELEASEES from any potential liability for loss, damage, expense or injury including death that I or my relatives may undergo as a result of my participation in one or more motorcycle trips, by any cause whatsoever, including negligence, breach of contract, or waiver of protection tasks, including protection tasks according to the law, with respect to the RELEASEES, and further including failure of the RELEASEES to protect me from the risks and dangers of the above motorcycle trips.
To release the Releasees from any potential liability for property damage or injuries caused to a third party as a result of his participation in one or more motorcycle trips.
This indemnity is also effective and binding upon his heirs, kin, executors, administrators and representatives in the event of his death or disability. This statement and any rights, duties and obligations between the parties of this statement are governed by Dutch law, regardless of the location where a motorcycle trip occurs and regardless of the location where a possible incident takes place.
2. Any disputes shall be settled by the competent court in the district Roermond in the Netherlands.
 

Conditions and circumstances by external calamity.

 
The tours of Crossroads Motortours are planned in a way that, as regards to the weather, it takes place in a favorable season . Many of the tours are in areas where the weather can significantly change and deteriorate in a very short period of time. Crossroads Motortours can not be held liable for damage or changes in the program due to poor weather conditions or natural disasters or acts of God. Crossroads Motortours will if possible and foreseeable offer and implement alternatives. In no case can there be any reimbursement of (part of) the fare.
 

Misprints.

 
Crossroads Motortours reserves the right to modify printing errors, without prior notice.
 

Local traffic regulations and local travel rules.

 
If a participant, after warnings from the supervisors, repeatedly disregards the local traffic and / or other travel rules or exhibits disturbing/annoying behavior that affects the trip or its other participants, Crossroads Motortours immediately unilaterally cancel the travel agreement. In the event that the trip has already started, this means that the participant will be placed outside the group and may continue his journey alone without the use of coaching and facilities of Crossroads Motortours and without the for him / her reserved hotels. In that case, no (part of) the fare will be refunded.
 

Passport, visa, driving proficiency and health.

 
The participant is responsible for complying with the local rules on passport, visa, driver / driver's license, insurance and health regulations. He / she will also bear all the consequences for not following the local regulations.
 

Statement.

 
By agreeing / accepting (by ticking on the reservation form or paying any part of the costs of the trip) with this statement I am not relying on verbal or written statements made by the Releasees with respect to the safety of motorcycle travel, except as described and put in this statement.
I confirm that I have read the terms and conditions and disclaimer and understood these. I am aware that these general conditions and I accept the disclaimer to renounce certain legal rights which I or my heirs, kin, executors, administrators and representatives may have against the RELEASEES.
